BarcelonaThere is already a sentence for the homophobic crime of Samuel Luiz. The first section of the Provincial Court of A Coruña has sentenced the three adults who murdered Samuel Luiz to terms of between 20 and 24 years in prison and 10 years to the accomplice. The court acquitted, instead, the only woman accused.
Samuel Luiz was killed with blows and screams of “fagot” the morning of July 3, 2021 in front of Riazor beach in A Coruña. He was 24 years old, and his figure immediately became an icon in the fight against homophobia in the State.
Now, more than three years later, the perpetrators of that crime have been convicted. The sentence made public this Wednesday imposes a sentence of 24 years in prison on the main defendant, Diego Montaña, since the judge attributes to him an aggravating factor of discrimination because he was the one who uttered the homophobic shouts against Samuel.
In addition, the magistrate also imposes a sentence of 20 years in prison for Alejandro Freire – since there are no aggravating factors in this case -; 20 and a half years for Kaio Amaral – 17 years for the murder and three and a half years for the robbery with violence – and 10 years in prison for Alejandro Míguez, whom the judge considers an accomplice to murder.
All four will have to compensate the family of Samuel Luiz with 304,000 euros and after leaving prison they will have to spend another five years of supervised release. The sentence is not final, as it is still possible to present an appeal before the Superior Court of Justice of Galicia.
As a result of this case, there are also already two convicts who were minors at the time of the events and who were tried in another procedure. These are David Rodríguez ‘Pompo’ and Marco Figueras, who were sentenced to three and a half years in prison. A pity that they will fulfill precisely this January.
