The 24 year old, remained in prison until June before the precautionary measure was replaced with a residence and access ban in the province of Bergamo and the municipality of Milan, he always maintained his innocence. There lawyer Alessandra Biglianiwho defends him at the trial, stated that the approach between the two young people would have been consensual. Following the alleged harassment, he explained, they would walked around the city together for an hour and a half.
The 24-year-old’s defense had requested a speedy trial on the condition that surveillance camera footage be acquired. However, due to a technical problem, they would be only a few frames displayed and in none of these there would have been no moments of tension.
The alleged victim, on the contrary, has always claimed that she was forced to suffer harassment from the 24-year-old and also repeated it during the trial. The 20-year-old said she met him that night and started talking to him shortly before started groping her. “I didn’t scream because there was no one around,” he had said, “and why I was terrified that he would hurt me“.
The Baraldo judge of the Court of Milan decided to acquit the accused with the formula “the fact does not exist” from the accusation of sexual violence. The reasons for the sentence of the first instance trial celebrated with an abbreviated procedure will be filed in 90 days.
