Driving a vehicle under the influence of alcohol, if it is above a certain value, is considered a crime. But if it is below this value, then the law is much more lenient. Here is the blood alcohol level at which the driver’s license is suspended in 2025 and under what conditions can the penalty be reduced?

At what alcohol level is the driver’s license suspended in 2025?
Emergency Ordinance 195/2002 establishes the limits of pure alcohol in exhaled air and its concentration in the blood. It also provides for the sanctions that the police can apply to the person who committed the offense.
„Driving a car or tram on public roads by a person with an alcohol concentration of over 0.80 g/l of pure alcohol in the blood (over 0.40 mg/l of pure alcohol in the exhaled air) is punishable by imprisonment from 1 to 5 years”, establishes ART. 87 of the Emergency Ordinance 195/2002.
Therefore, an alcohol concentration of over 0.40 mg/l in exhaled air is a crime. The driver will be taken to a medical facility for collection of biological samples. If he is found to have an alcohol concentration of over 0.80 g/l in his blood, his driving license will be automatically suspended and the Police will file a criminal case against him. The same penalty applies to those who drive under the influence of drugs.
But, in the case of those with a lower alcohol concentration in the exhaled air, the law is more lenient.
Thus, for a concentration between 0.01 and 0.40 mg/l of alcohol in exhaled air, the driver will be fined for contravention. At the same time, the driver’s license will be suspended for 90 days. And the police can apply a contravention fine of up to 4,050 lei.
When your license is suspended for alcohol, can you reduce the penalty if you take the test?
Drivers who have been fined for driving under the influence of alcohol can only regain their license at the end of the suspension period. Thus, there is no possibility of obtaining a reduction of the period of suspension of the carnet when it comes to alcohol consumption.
In contrast, in the case of drivers who have committed an offence, the period of suspension is indefinite.
The law states that the license of those who have the right to drive suspended for alcohol or drugs cannot be regained until the completion of the criminal investigation or after the execution of the sentence.
Which means that during this period you will have your license suspended and you cannot drive.
