Everyone should know that you live in an area, on a multi-lane road, on the lanes going in the same direction parallel traffic principle applies, so you can safely overtake another vehicle even from the right. On the highway, however, it is different, overtaking on the right is strictly prohibited, BUT!
There is a difference between overtaking, avoiding and passing.
KRESZ clearly states that overtaking must be done from the left in most cases. However, there are some exceptions when you can overtake from the right:
- the vehicle that indicates the intention to turn left with a direction signal and is located on the road in accordance with this provision;
- the tram that runs on the track in the middle of the road – on a one-way road on the left side of the road;
- in addition, we can also overtake a vehicle using a flashing yellow light signal from the right, if the driver is convinced that this does not endanger other vehicles or pedestrians.
In light of these, we can therefore state that even on the highway, you can only overtake from the left. Even if we arrive behind a slower moving car in the inner lane, we have to wait until it moves out in front of us into the outer lane, and only then can we overtake it. But still there is a situationwhen we can legally pass from the right, next to another vehicle on the highway.
The following passage can be read in the KRESZ:
“Overtaking is passing a vehicle traveling in the same direction as the vehicle on the road. In the case of parallel traffic, the passing of vehicles continuously moving in different traffic lanes next to each other is not considered overtaking.”
Translated: if cars are moving continuously on a multi-lane road, but one traffic lane slows down and because of this the right lane is faster, the drivers who overtake the vehicles in the left lane, so to speak, are not breaking the rules. In this case, they just pass the vehicles without changing lanes, so their action is not considered overtaking.
However, it is up to those in uniform to consider the question of exactly what period of time a lane change is considered overtaking…
However, pay close attention to the fact that on a three-lane highway, if you drive in the middle lane – because you have overtaken someone from the outside – and you catch up with another vehicle in the middle, who is losing there, even if you just moved back to the outside – the obligation to keep to the right because of -, you can’t pass by those wasting money in the middle from the right. This maneuver is already considered overtaking and as such is illegal.
