The employer has the right to demand that an employee maintain a trade secret, as well as stipulate penalties for its disclosure. Hedman Lawyer Christel Tael-Same explained what an employee needs to know about this obligation and what actions an employer can take if a trade secret is violated.
Recently, the Estonian Supreme Court issued a final decision in a case in which an employee, having transferred to work for a competitor, sent documents containing trade secrets of his former employer to his personal email. The court concluded that such actions were not necessary for the performance of job duties and ruled that the employee had violated the obligation of non-disclosure of trade secrets and was obliged to pay a fine of almost 17,000 euros to his former employer.
