ACM warns against rogue Berkenboschmode.com

The Netherlands Authority for Consumers and Markets (ACM) warns against online store Berkenbosch Mode due to incorrect and missing information about delivery times, inaccessible customer service and problems with returning purchases. In recent months, ACM has received many complaints about this online store through consumer desk ACM ConsuWijzer.

Berkenboschmode.com offers various products, especially women’s clothing. This online store uses dropshipping. This means that it has products sent directly from abroad – in this case China – to consumers. Information about this is lacking on the site. Consumers are thus misinformed about the actual delivery time and method of delivery.

Consumers can still place orders at Berkenbosch Mode. The ACM has made several attempts to contact this online store. Berkenbosch Mode did not respond to this. To prevent further damage to consumers, ACM now warns about the practices of this online store.

For example, on the website, Berkenbosch Mode advertises on the product pages with ‘Ordered before 11 p.m. = shipped tomorrow’. It is not stated on the website that the product will be shipped to the consumer from China. The reports received by ACM show that the delivery time is around 3 weeks. However, the website states that orders in the Netherlands will be delivered after 3-5 working days. In addition, consumers are misled because the company name on the website states ‘Berkenbosch Amsterdam’. These terms give the impression that the product will be delivered within a short time, for example a few days.

Furthermore, the reports show that the articles are presented too well and do not match the photos on the website. When consumers want to make use of their statutory cooling-off period, they receive offers from customer service for a discount voucher or gift voucher. Consumers who indicate that they do not agree to this will no longer receive a response. While people are entitled to money back. People also report that it is not possible to return products. In this way, consumers are prevented from exercising their right to return.
