Adidas and Thom Browne are once again facing each other in the battle for the three stripes. The dispute surrounding alleged infringement of Adidas’ trademark by the eponymous New York fashion designer is resuming in the High Court in London. This is reported by the news platform Reuters.
The dispute began in 2021 when Adidas sued Thom Browne for infringing on his trademark: the three stripes. There would be a likelihood of confusion. Browne argued that there could be no infringement of Adidas’ trademark for the following reasons: the brands operate in different markets, have different target audiences and have far different price points. A jury in Manhattan ruled in Browne’s favor in January 2023.
But Adidas’ lawyers have consistently maintained that Thom Browne is harming Adidas. In the lawsuit, Adidas’ attorney Charlotte May recalled Thom Browne’s 2020 launch of a sportswear line. She also pointed to Thom Browne’s collaborations with basketball player LeBron James and Spanish soccer club FC Barcelona as evidence of “meddling in sportswear and sports marketing.”
Adidas wants to review the case against Thom Browne. The case is now continuing in London, before the High Court. The trial is expected to conclude next week.
