ANAF goes after money: Over 5,900 fiscal actions in June 2024

ANAF carried out, in June, over 4,000 fiscal controls, an increase of 26.73% compared to June last year.

The National Agency for Fiscal Administration carries out two types of actions that involve remote interaction with the taxpayer:

– the issuance of the compliance notice, which is a document through which the tax inspection body transmits to the taxpayers/payers presumed to be selected for the tax inspection the identified tax risks, in order to reanalyze the tax situation and fulfill the tax obligations according to the legal provisions or to clarify the tax risks notified, as appropriate.



– carrying out documentary verification actions, which consist in carrying out a coherence analysis of the tax situation of the taxpayer/payer, based on the existing documents in the tax file of the taxpayer/payer, as well as on the basis of any information and documents transmitted by third parties or held by the fiscal body, which are relevant for determining the fiscal situation.

Taxpayers with high fiscal risk are subject to fiscal control actions, respectively:

– the fiscal inspection in the case of taxpayers who do not correct and clarify the fiscal risks for which they were notified through the Compliance Notice

– anti-fraud control in the case of taxpayers for whom there are indications of tax evasion.

“We see a real streamlining of fiscal control and anti-fraud control activities, which are aimed at economic operators with high fiscal risk. With the digital tools that we calibrate better from month to month, the selection for tax inspections has already moved into the realm of risk analysis algorithms. Although at the global level, in the first half of the year the number of controls is similar to last year, more sanctions were applied, which shows us an increase in the level of efficiency. The most important aspect is that digitalization allows us to protect and respect honest taxpayers, allowing them to carry out their activities without unnecessary interventions from the tax authorities”, Minister Marcel Boloş said.

In June 2024, to increase voluntary declaration compliance, 1,330 notifications were sent to taxpayers, as follows:

– 1,195 compliance notices issued by the tax inspection bodies, for presumed fiscal risks of 278,048,299 lei, the notified fiscal risks mainly concerned the Value Added Tax and the profit tax

– 135 specific notifications issued by the tax anti-fraud control bodies, regarding the erroneous data registered in the RO-E Transport application.

Also took place:

– 4,201 fiscal control actions (fiscal inspections and documentary checks), being a 26.73% increase, compared to the similar period of 2023, when 3,315 fiscal control actions (fiscal inspections and documentary checks) were completed

Through these fiscal control actions, additional fiscal obligations were established through taxation decisions of 281,964,530 lei, respectively, the recorded fiscal loss was reduced by the amount of 65,844,206 lei.

– 1,783 anti-fraud controls, through which fiscal implications were estimated in the amount of 165,902,853 lei, respectively contraventional sanctions (fines and confiscations) in the amount of 18,210,144 lei were applied, an increase of 87.62% compared to the similar period of 2023, when contraventional sanctions (fines and confiscations) in the amount of 9,705,635 lei were applied.

In June 2024, 69.30% of the additional fiscal obligations as a result of fiscal inspection actions were established for taxpayers who carried out their activity in the following activities in the national economy:

– Transport and storage – 34.80%

– Wholesale, retail trade, repair of motor vehicles and motorcycles – 20.32%

– Manufacturing industry – 14.18%.

More than 68% of the amount of fiscal obligations additionally established by the fiscal inspection bodies was on account of the value added tax, which confirms the commitment of the fiscal administration to reduce the VAT gap.
