Are you required to wear a seat belt in Uber if you are a customer? What about the driver?

The traffic law requires the use of seat belts by all occupants of a motor vehicle. This safety device is designed to protect both the driver and the passengers. But are you required to wear a seat belt if you are an Uber customer or driver, or in another ridesharing vehicle?

The seat belt is one of the most important protection systems for passengers and drivers of a motor vehicle.

By law, all occupants of a car are required to wear a seat belt, regardless of whether they are sitting in the front or the back. Otherwise, they risk penalties of hundreds of lei.

Seat belt fine in 2024

Wearing a seat belt is required by law for all drivers who drive a car on public roads.

The penalty for drivers and passengers not wearing seat belts is between 2 and 3 fine points. Which means a penalty between 330 and 495 lei.

The role of this belt is to protect both the driver and passengers in the event of a road accident.

Is it mandatory for rear passengers to wear seat belts?

The traffic law states that every car occupant is responsible for wearing a seat belt. Thus, both the driver and the front passenger, as well as the occupants of the rear seats, are required to wear a seat belt.

Otherwise, in the event of a traffic control, all those who do not use this safety device risk being penalized. And the fine is applied individually, to the person who is caught without a belt.

Which means that, for example, if the driver is wearing a seat belt, but the two passengers in the back seat are not, then each of the two passengers will be penalized with 2 or 3 penalty points.

The legislation provides, however, several exceptions to this obligation to use a seat belt.

Are you required to wear a seat belt in Uber if you are a customer?

The regulation of the application of the Highway Code establishes several exceptions regarding the obligation to use the seat belt.

Specifically, they are not required to fasten their seat belts:

  • car drivers, during the execution of the reverse maneuver or who are stationary;
  • women in a visible state of pregnancy;
  • car drivers who perform public passenger transport services, in taxi mode, when transporting passengers;
  • people who have a medical certificate in which the condition that does not allow wearing a seat belt is mentioned;
  • driving instructors, during the practical training of people learning to drive a motor vehicle on public roads or the examiner during the practical tests of the driving license exam.

Therefore, taxi drivers are not obliged, when transporting passengers, to use seat belts. However, the law makes no reference to ridesharing companies, such as Uber, Bolt or TaxiFy.

Which means that both the drivers of these vehicles and the passengers are required to wear seat belts.
