Changes in the construction sector – Entry into force of the regulations on waste

In order to improve construction waste management and reduce the number of illegal landfills, a new rulebook will be implemented in Serbia that will significantly change the way construction waste is processed and deposited.

The Rulebook on the arrangement, management, disposal and deposit of construction waste during the execution of works, which was adopted by the Minister of Construction, Transport and Infrastructure, is in accordance with the recent amendments to the Law on Planning and Construction, which requires stricter control and handling of construction waste during and after execution of works, it is stated on the website of the Ministry of Construction, Transport and Infrastructure.

A key provision of the new rulebook is the obligation of investors to prove that all waste has been handed over to authorized operators for treatment and storage before obtaining a use permit. This obligation applies to all investors whose decisions on construction permits were issued after August 4 of the previous year. In addition, the rulebook stipulates that the investor must attach a document on the movement of waste, which is a prerequisite for issuing a use permit.

Due to the lack of licensed waste processing and storage facilities in some parts of the country, the ordinance provides a temporary exemption from the submission of this document, for investors located in an environment where such facilities are not available within the first 50 kilometers. In such cases, investors are obliged to submit a statement that will be checked by the competent authorities, as proof that the necessary infrastructure capacities do not exist in their environment.

The Rulebook also introduces the mandatory creation of a Construction Waste Management Plan for all works on buildings of certain categories. The plan should include all relevant information about the building to be demolished, the types of materials from which the building was built, as well as other data important for dealing with the resulting waste. Based on the Management Plan, the contractors will be responsible for the proper handling of waste on the construction site.

The minister also announced plans to introduce new regulations that will regulate the obligation to use recycled construction materials in the rehabilitation and construction of roads, which will further contribute to environmental protection and the promotion of circular economy principles.
