According to News 1 on the 23rd, Busan District Court Criminal Division 3-3 (Chief Judge So-yeon Lee) sentenced Mr. A, in his 30s, who was indicted on charges of violating the Housing Act, to a fine of 2 million won, as in the first trial.

According to the facts acknowledged by the first trial, in June 2022, Mr. A applied for and won a special supply for newlyweds of a new apartment in the area by having his address in Busan even though he did not actually reside in Busan.

The current Housing Act states that ‘no one shall receive housing in accordance with the Housing Act by false or other fraudulent means.’

In the first trial, Mr. A claimed, ‘I only reported moving to Busan to take care of my older brother in Busan, and did not intentionally violate the housing law.’

However, the first trial court sentenced him to a fine of 2 million won, saying, “The defendant can take care of his brother at his existing registered address, and there is no reason to report moving to Busan.”

Mr. A then appealed, claiming that he had won the subscription regardless of his place of residence, but the second trial court said, “The priority for lottery drawing for this special supply subscription is to be a resident of Busan City,” adding, “Since he won the subscription without actually residing there, It was dismissed on the grounds that “the charges are acknowledged.”
