The Romanian Senate is analyzing a proposal to change the traffic law. Its initiator proposes that drivers who refuse to present their driver’s license or who do not have it on them, will no longer be fined.
The traffic law establishes which are the mandatory driving documents for all drivers.
They must be presented, in original, to the police in the event of a traffic control.
Mandatory documents for all drivers
When a driver is stopped by the Police for control, the driver is obliged to present several documents.
„Traffic participants are obliged, at the request of the traffic policeman, to hand over their identity document or, as the case may be, their driver’s license, registration or registration document of the vehicle they are driving“, establishes ART. 35 (2), from law 195/2002.
Therefore, the mandatory documents that drivers must have on them at all times are:
- driver’s license;
- car ticket;
- compulsory car insurance (RCA);
- identity card.
Among these car documents, only the insurance can be presented in electronic format. The other documents, i.e. the license, ticket and ticket, must be handed to the police officer in original.
Those who do not have or do not want to present one of these documents to the control, risk between 6 and 8 fine points. Which means that the penalty can reach 1,320 lei.
Drivers will no longer be fined if they refuse to present their driving license
A legislative proposal was submitted to the Senate proposing to amend article 35, paragraph (2).
„Traffic participants are obliged, at the request of the traffic policeman, to hand over to him any identity document among those provided by art. 12 para. (3) from GEO 97/2005 regarding the records, domicile, residence and identity documents of Romanian citizens, the registration or registration document of the driven vehicle, the documents related to the transported goods, as well as other documents provided by law”, is the new one text de lege proposed.
It is also proposed to introduce an additional paragraph.
„The proof of the existence and validity of the driver’s license, in the case of controls carried out by the competent authorities, is made by querying the database of the General Directorate of Driving Licenses and Registrations and the related regional structures”, is the paragraph that is proposed to be inserted in Art. 35, after point 2.
Thus, drivers who do not have their license on them or refuse to present it, will no longer be penalized. On the other hand, those who do not present the coupon or bulletin will still be fined.
But, for now, the project is in the analysis phase of the Senate. If it is adopted, it will enter the debate of the Chamber of Deputies, which is the decision-making body. Only if it is adopted by the two chambers and receives the approval of the President of Romania, the law will be amended.
