According to the new law, adopted in July, if a driver tests positive for a rapid drug test, he remains without a license. A blood test is also ordered to determine exactly whether the driver in question has consumed drugs or if the result is false-positive.
If the blood test is not ready within 72 hours, drivers get their license back. Basically, the driver’s license will not be suspended for more than 3 days based on rapid drug tests.
If the result is determined to be a false positive, the driver will receive a notice informing them that the criminal investigation for driving a vehicle under the influence of psychoactive substances will not be continued.
But if the blood tests confirm the presence of drugs in the body, his license will be suspended again and a criminal case will be opened.
On average, about a quarter of these rapid tests turned out to be false positives. In these cases, the results of the Drugtests were refuted because the substance detected by the police devices came from various drugs, supplements or foods.
