Elon Musk has stepped up his legal battle against Open AI and Microsoft. The serial entrepreneur claims that the companies have colluded to eliminate competition in an attempt to dominate the development of AI and has now updated a lawsuit. The Wall Street Journal reports.

In the lawsuit, Open AI’s CEO Sam Altman is accused of having benefited himself through deals between Open AI and companies in which he has interests, and that Open AI has “merged” with Microsoft, a formulation that recurs in the accusations, writes the business newspaper.

This extended legal process comes as Musk was appointed by President-elect Donald Trump to lead a new department to streamline the US government.

Investors scared away from xAI?

In a previous lawsuit in February, Musk alleged that Open AI and Altman had violated the company’s original ideals by prioritizing profit over societal benefit and that Open AI’s collaboration with Microsoft is contrary to the original vision of an open AI.

After withdrawing the lawsuit in June without explanation, he reactivated it in August with new allegations of deceptive business practices and claims that Open AI had defrauded him of more than $44 million in donations between the years 2016-2020.

Elon Musk is now accusing Open AI and Microsoft of discouraging investors from backing competitors, such as his own company xAI, by demanding promises not to fund rivals.

Microsoft, which invested $13 billion in Open AI in 2019 and 2023, as well as Hoffman, have yet to comment, according to WSJ.
