ETA prisoner Xabier Atristain has been released on parole after spending a total of thirteen years in prison. The Strasbourg Court declared that his guarantees were not respected as he did not have a lawyer during his incommunicado detention.
As Etxerat has recalled on social media, in March of last year the Central Court of Penitentiary Surveillance of the National Court (AN) decided to return ETA prisoners Xabier Atristrain and Juan Manuel Inciarte to prison.
Third degree
Judge MarĂa Reyes Jimeno thus admitted the appeal filed by the Prosecutor’s Office against the agreements adopted by the Department of Justice of the Basque Government on March 2, 2023 by which It was agreed to promote these two prisoners to third grade.
The decision of the National Court was made in application of the doctrine established by the Supreme Court, which establishes that the appeal by the Public Prosecutor’s Office regarding the progression to third degree has a “suspensive effect” until its resolution.
