Tiktok’s attempt to escape DMA failed, remains a gatekeeper.
Earlier this year, the EU classified the video service Tiktok as a so-called gatekeeper, according to the regulations Digital Markets Act. This means, among other things, that a company is prohibited from giving advantages to its own products in the ranking, or from preventing customers from removing pre-installed software, as well as from collecting data outside the main platform without users’ consent.
The parent company Bytedance appealed the decision to the European Court of Justice, arguing among other things that the EU would have used incorrect information when making the decision. Now the EU court has had its say, and there it is stated that Tiktok must be classified as a gatekeeper and thus covered by its regulations.
In a statement, Tiktok writes that they are disappointed by the decision and have “taken steps to live up to the relevant obligations under the DMA”, but that they have not decided how to proceed.
