Fine for drivers who did school on automatic and drive a car with manual transmission?

Romanian law distinguishes between cars with an automatic gearbox and a manual gearbox. Furthermore, it is not legal to drive a manual car unless you have passed your practical test in such a vehicle. But how much is the fine for drivers who have completed the school on the automatic and drive a car with a manual transmission?

If you did your driving school in an automatic transmission car, by law you are not allowed to drive a vehicle that has a manual gearbox.

In order to be able to drive a vehicle with a manual transmission, in theory, you should take your practical test in such a car.

Restrictions for those who completed school on a car with an automatic transmission

Legally, those who have completed driving school in an automatic transmission car can only drive vehicles with automatic transmission.

If the candidate passes the practical test with a vehicle equipped with an automatic gearbox, this will be entered in the restrictions section of the driving licence. (…) Ohrice permit containing this mention may only be used for driving a vehicle equipped with an automatic transmission”, establishes Art. 16 of Order 574 of April 1, 2005.

Theoretically, on the carnet this restriction will be noted with the number “78” next to the vehicle for which the driver obtained a driving license.

Holders of driving licenses in which there are mentions regarding the right to drive motor vehicles with automatic transmission, who apply to obtain the right to drive motor vehicles with manual transmission of the same category, must take a new practical test, under the condition of presenting the document whose model is provided in annex no. 9, which certifies the performance, in a driving school, of at least 6 hours of practical driving of a vehicle with a manual transmission”, it is specified in Order 268 of December 2010, in Art. 15.

So, at least in theory, it’s not legal to drive manual transmission cars if you went to school on “automatic”.

Do you get a fine if you did school on “automatic” but drive “manual”?

In practice, drivers cannot be fined if they have completed the school on an automatic car, but drive a vehicle with a manual transmission.

The law does not establish any penalty for the violation of the above two Orders.

Thus, regardless of the type of vehicle you took driving school on, you can drive both an automatic and a manual car.
