For which diseases is a disability certificate obtained in Romania

Disability certificate. In Romania, Romanian citizens, foreigners or stateless persons who have their domicile or residence on the territory of the country benefit from the rights and obligations established by Law no. 448/2006 on the protection and promotion of the rights of persons with disabilities.

The placement of children with disabilities is carried out by the child protection committee, while adults are assessed by the assessment committee for adults with disabilities. These commissions issue a disability classification certificate, which reflects the degree and type of disability.

The medico-psychosocial criteria used to determine the degree and type of disability are approved by a joint order of the Minister of Labour, Family and Social Protection and the Minister of Health.

Degrees and types of disability

According to Article 86 of the Law on the Protection and Promotion of the Rights of Persons with Disabilities, there are four degrees of disability: mild, medium, accentuated and severe. Ten types of disability are also recognized: mental, psychic, auditory, somatic, physical, visual, deafblindness, HIV/AIDS, associated and rare diseases.

Certificate of mental disability

The certificate of mental disability is granted for the following conditions:

  • Mental retardation and mental retardation
  • Autism spectrum disorders
  • Atrophic-degenerative, organic and non-cognitive dementias

Certificate of mental disability

For mental disability, the certificate is issued in the case of the following conditions:

  • Schizophrenia
  • Schizoaffective disorder (depressive or bipolar)
  • Chronic major depression
  • Bipolar affective disorder
  • Psychoses associated with mental retardation
  • Psychoses associated with personality disorders, such as paranoid, schizoid, antisocial or emotionally unstable (borderline) disorder

Hearing disability certificate

This certificate is issued to people with hearing conditions, including:

  • Congenital or early-acquired hearing loss with poor or no muteness and severe communication impairment (deafmutity)
  • Bilateral early-acquired hearing loss with hearing loss over 70 dB, difficult to repair, associated with mental and language disorders

Physical disability certificate

Somatic disability is recognized for conditions that affect body functions, including:

  • Chronic immune deficiency
  • Endocrine, metabolic, skin, hematological, renal, cardiovascular and respiratory disorders

Disability certificate for rare diseases

Among the rare diseases for which a certificate of disability is granted are:

  • Mastocitoza
  • Fabry disease
  • Pompe disease
  • Prader-Willi syndrome
  • Narcolepsy
  • Phenylketonuria
  • Sickle cell anemia
  • Idiopathic pulmonary fibrosis
  • Tuberous sclerosis
  • Amyotrophic lateral sclerosis
  • Evolutionary digital ulcers
  • Thalassemia
  • Duchenne muscular dystrophy
  • Gaucher disease
  • Systemic sclerosis

According to Law 190 of 2018, Article 7, journalistic activity benefits from exemption from certain provisions of the GDPR Regulation, provided that a balance is maintained between freedom of expression and the protection of personal data.
