Govt ’embarrassed’ by dumping case: Legal Adviser

Legal advisor Professor Dr. Asif Nazrul He asked the members of the Judicial Reform Commission for advice on what to do to deal with this crisis.

He said this on Tuesday evening after a meeting with the Judicial Reform Commission at the Judicial Administration Training Institute.

The legal adviser said, ‘I have specifically asked them for help in two matters. During the previous fascist regime, there were cases of disappearances. On behalf of the government, cases were filed in absentia. And now we are not giving any case on behalf of the government. Common people, victimized people, political opponents, they are also filing cases against others.’

He said, ‘There has been a very serious outbreak of Dhalao cases in the country. This embarrasses us greatly. We are considering many types of legal reforms. Thinking of taking legal action. One of our expectations from NAD is that they have come to seek advice on how to tackle the matter legally. They will advise, work and research.’

In another matter, the legal advisor said, ‘We want to do it through a law that will be appointed in the next high court. The demand to be made through law has been there for a long time in the society. Such a law was passed in 2008. Later it was not converted into law. The previous fascist government did not turn it into law. I have sought their (Judiciary Reforms Commission’s) help to make that law more up-to-date, so that we can make the next appointment through the law.’

Asif Nazrul said about the activities of the Judiciary Reform Commission, ‘I want to know the progress of the work of the commission in the discussion. The way they are going, I am very hopeful….They (Judiciary Reforms Commission) have also mentioned some problems. I can’t give them enough support.’

The Judiciary Reforms Commission was constituted on October 3 with the approval of the Chief Adviser to the Interim Government to propose necessary reforms to make the Judiciary independent, impartial and effective.

The head of the commission is Shah Abu Naeem Mominur Rahman, a retired judge of the Appellate Division. The other members are retired High Court Judge Emdadul Haque, former District and Sessions Judge and High Court Division Judge Farid Ahmed Shibli, former District and Sessions Judges Syed Aminul Islam and Masdar Hossain, Supreme Court lawyer Tanim Hossain Shawon, Dhaka University Associate Professor Kazi Mahfuzul.
