There are many situations in which drivers honk, whether they have a good reason or not. But most refrain when a police crew is nearby.
It was not the case of a man from Iași county, who even honked at the police crew. The reason: the van was parked badly and was confusing traffic.
He honked the horn at the police car for confusing traffic
Everything happened on Architect Beldiman Filaret Street in Miroslava, Iasi County.
The man observed that a police car was irregularly stopped in front of him. It occupied a good part of the only lane in the direction, which forced the drivers to step on the continuous line to be able to pass it, writes The newspaper of Iasi.
When passing the special vehicle, the man honked his horn to draw the attention of the police that they did not have their lights on and were confusing the traffic.
The reaction of the police was prompt!
What happened to the driver after he honked at the police car
The man was immediately stopped by the police and fined for abusive use of the horn and failure to comply with the obligation to stay in the car at the time of drafting the violation report.
In total, he was fined 1,160 lei and his driver’s license was suspended for 130 days.
The driver considered this penalty to be abusive, so he challenged it in court. And the judges, partially, gave him the right.
The court annulled the report
In the analysis of the file, the judges proceeded first of all to verify the correctness of the document drawn up by the police. They found that there are no cases of absolute nullity that can be invoked ex officio.
Instead, the police had wrongly indicated one of the legal classifications made for sanctioning the driver.
They had mentioned “art. 91 lit. a from GEO 195/02”, text which was already repealed before the ascertained fact.
The mistake could not be corrected, requiring the partial annulment of the minutes. The first reason for sanctioning, namely the use of the horn without justification, remained to be analyzed. In front of the court, the representatives of the County Police Inspectorate did not contest the fact that the police van was stopped in the area marked with a continuous line, making traffic difficult.
„The use of the horn in this context does not appear as abusive, but as a desirable warning to avoid road accidents caused by the untimely stopping of the police vehicle“, appreciated the judges.
The magistrates noted that the police car was stopped to control a traffic participant. But this had to be done on the shoulder, in an area where it would not confuse other drivers. Thus, it is not about an abusive use of the horn, but about civic spirit.
The report was annulled in its entirety, but the Court’s sentence was contested by the Road Service of the IPJ. The appeal went to the Tribunal, this court will set the future court date.
