He was caught with an unlicensed gun: He was arrested

Akın Gürlek, who was appointed as the Istanbul Chief Public Prosecutor with the latest decree published by the Council of Judges and Prosecutors (HSK), held a meeting with the Deputy Chief Public Prosecutors and police officials.

At the meeting, within the scope of the “Law on Firearms, Knives and Other Tools” No. 6136, which includes the regulation on unlicensed weapons, the decision taken to send the persons caught carrying unlicensed weapons to arrest after their statements were taken, separately from other crimes, was conveyed to the prosecutors.

In this context, the suspect, whose unlicensed weapon was seized in Bayrampaşa on October 26, was detained and referred to the prosecutor’s office. Suspect CA, whose statement was taken by the Istanbul Chief Public Prosecutor’s Office, was sent to the judgeship on duty with the request for his arrest.

In the referral letter sent by the prosecutor’s office to the criminal judgeship of peace about the suspect CA, requesting arrest, it was stated that an unlicensed weapon was seized from the suspect in Bayrampaşa on October 26, and that the crime of “possession of an unlicensed weapon” charged against the suspect requires a prison sentence of 1 to 3 years.

In the article, it was emphasized that the crime of “possession of an unlicensed weapon” constitutes a predicate crime for many crimes due to the rapid increase in crimes committed with weapons in Turkey and the grave nature of the incident.

In the article, it was emphasized that the crime charged against the suspect was the reason for his arrest, and his arrest was requested, taking into account the current state of evidence and the upper limit of the penalty requested for the crime.

In his statement at the Istanbul 10th Criminal Court of Peace, suspect CA claimed that he was carrying a gun because he was afraid and asked for his release.

In his defense at the court, the suspect’s lawyer demanded the release of the suspect C.A., claiming that his client went to his mother and was carrying a gun because the neighborhood he lived in was not safe.

The judgeship noted that the suspect had a high probability of escaping and hiding due to the lower and upper limits of the penalty for the crime of “possession of an unlicensed weapon” and stated that imposing judicial control measures on the suspect would be insufficient.

For this reason, the judgeship ordered the arrest of the suspect C.A.
