How many passengers can you carry, legally, with a category B license? What is written in the Highway Code 2024

Each license category entitles the driver to transport a certain number of passengers. Those who transport people must obtain a separate license to carry out this activity. Here is how many passengers you can carry, legally, with a category B license.

The maximum number of passengers you are allowed to carry with a Category B license is set by road legislation.

The fine for those who violate this law can exceed 1,000 lei.

How many passengers can you carry, legally, with a category B license?

The Highway Code states that the holder of a Category B driving license can drive a “motor vehicle whose maximum authorized mass does not exceed 3,500 kg and whose number of seats, apart from the driver, does not exceed 8”.

So, in a car driven by a driver who only has a Category B license, there can be no more than 9 people. Specifically, the legal maximum number is 8 passengers and 1 driver.

But, it depends on how many approved seats that vehicle has.

How many seats does a car have?

The license plate of each vehicle states how many seats are approved for the driver and passengers.

Most cars have 4 or 5 seats. Two are in the front – driver and passenger. They each have an individual seat. Another 2 or 3 seats are in the back, on the bench.

Each seat is equipped with its own seat belt, both front and rear.

But there are also vehicles, such as Land Rover Discovery or Opel Zafira, which are equipped with 7 seats. Generally, these models have a bench seat or two individual seats mounted in the trunk, which can be folded down completely.

You can also drive minibuses, such as Mercedes Vito, Renault Traffic or VW Transporter, with a Category B license. Of course, the condition is that they do not have more than 9 seats in total.

At the opposite pole, there are models with only 2 seats in the front, one for the driver and one for the passenger. And the rear cabin is exclusively for cargo transport. Dacia Duster pick-up or Toyota Hilux pick-up can fall into this category.

What happens if you carry more passengers than is legal

Drivers who are caught by the Police carrying more passengers than they are entitled to according to the license category they hold, risk being fined.

It constitutes a misdemeanor and is sanctioned with a fine provided for in the III class of sanctions (…) non-compliance with the rules regarding the transport of people and objects in or on vehicles”, provides Art 101, point 1 (13), of Ordinance 195/2002.

Which means the driver will receive between 6 and 8 penalty points. So he will have to pay between 990 and 1,320 lei.
