Important changes for these categories of pensioners

Pensioners who are members of the creative unions encountered difficulties regarding the increase in allowances due to a legislative shortcoming. The problem arose with the implementation of the new Pensions Law (Law no. 360/2023), which introduced the concept of “point of reference”, replacing the previous term “pension point” used in Law no. 8/2006.

The legislative deadlock regarding the increase in allowances for retired members of creative unions was caused by the transition to a new calculation model introduced by Law no. 360/2023, which uses the “reference point” value instead of the “pension point”. This made it impossible to update allowances according to the new regulations, because Law no. 8/2006, which established the calculation method of these allowances, had not been correlated with the new system.

To remedy this problem, the Government adopted Emergency Ordinance no. 127/11.11.2024. The changes allow allowances to be updated based on the “benchmark” so that pensioners benefit from the adjustments set out by the new legislation.

Conditions according to Law no. 8/2006

  • The allowance for members of creative unions is equal to half of the pension in payment.
  • It must not exceed two minimum gross salaries per country, the maximum amount being 3,700 lei starting from July 1, 2024.

In Iași County, approximately 600 retired members of creative unions benefit from this allowance, according to the new regulations, which ensures the correctness of the recalculation according to the recent changes brought by the government, notes The newspaper of Iasi.

Thus, through this ordinance, the correlation of allowance calculation with the new legislative provisions was facilitated, providing clarity and financial support to pensioners in this sector.

“According to the new provisions, the amount of the monthly allowance benefited by pensioners who are members of the creators’ unions will no longer be related to the value of the pension point, but to the value of the reference point provided for in the new pension law and will be indexed or updated according to for this”, it is stated in a CNPP press release.
