Corning’s concessions include waiving all exclusivity clauses in its current agreements, as well as promising not to include such clauses in its future contracts. Additionally, the toughened glass manufacturer will no longer impose minimum quantities on customers.
If accepted these Cornint changes will affect its contracts worldwide and the European Commission will monitor the company for 9 years to ensure compliance.
There is also a free right for third parties to challenge the decision within six weeks before it takes effect. In the event that Corning violates the agreement with the EUwill face fines of up to 10% of its global turnover for 2023, which is about $1.25 billion.
