On Monday, around 1:40 a.m., in Rugai Parish of Balvu County, on the Kārsava-Tilža-Dubļukalns highway, police officials noticed a suspicious car “Volvo V70”, the driver of which crossed the middle line of the road section several times, as a result of which it entered the opposite lane.
The law enforcement officers decided to stop the car. It has been established that the car is being driven by a woman born in 1997, who has not obtained the right to drive a vehicle in the prescribed manner. An alcohol test was also conducted and the law enforcement officers recorded that the woman sat at the wheel of the vehicle under the influence of 2.43 ppm.
The woman’s husband, who was under the influence of alcohol, and three young children – seven and six years old, as well as a two-month-old baby – were also in the car. Considering that both parents were unable to provide full care and safety of the children in this condition, the children were transferred to the care of another family member.
In connection with this event, criminal proceedings have been initiated according to the first part of Article 262 of the Criminal Law, namely for driving a vehicle without the appropriate category of driving license and if the driver is under the influence of alcohol, narcotic, psychotropic, toxic or other intoxicating substances. The law provides for a penalty of imprisonment for a period of up to one year or with temporary imprisonment, or with probation supervision, with the deprivation of the right to drive a vehicle for five years.
Also, an administrative violation process has been initiated against the mother for supervising the children while under the influence of alcohol, which can limit the ability to ensure the child’s safety and protection from possible threats to the child’s life and health, if this was done by the person responsible for supervising the child. According to the Law on the Protection of Children’s Rights, a warning or a fine of up to 210 euros is applied for such an administrative violation.
The police emphasize that one of the most responsible and important tasks of parents is to take care of the life and safety of children.
