Getting a fine is never a good feeling. Firstly, there may be an associated amount to pay and an additional penalty. A fine for being “caught” on a mobile phone is serious and heavy.

We all know that using a mobile phone is prohibited while driving. But it's not just mobile phones...
According to the Article 84 - Prohibition on the use of certain devicesof the Highway Code.

Drivers are prohibited from continuously using or handling any type of equipment or device that could impair driving, including headphones and radiotelephones, while the vehicle is in motion;
The following are excluded from the previous number:

Devices equipped with a single earphone or microphone with a speakerphone system, the use of which does not involve continuous handling;
The devices used during driving instruction and the respective exam, under the terms set out in the regulations.


The installation and use of any equipment, devices or products that may reveal the presence or disrupt the functioning of instruments intended to detect or record infringements is prohibited.

Types of infractions when using equipment while driving

Using your cell phone to talk: holding a mobile phone to your ear whilst driving constitutes a serious offence;
Sending text messages: in this case, the driver normally has to continuously handle the equipment, which also requires visual and cognitive attention.
Use your cell phone: any action that involves touching the cell phone, even for a moment, such as checking notifications, is also considered an infraction;
Mobile phone usage activities while walking: if you use your cell phone for anything other than calling someone, it is also considered an infraction, as in addition to increasing the driver's distraction and the risk of accidents, the driver has to constantly handle the device.


Cell phone fine: severity and fine
In Portugal, using a cell phone while driving is considered a serious infraction. Fines and penalties may vary depending on the severity of the offense.

more: Using a mobile phone without a hands-free device can result in a fine of between €250 e €1.250.
Points in the letter: In addition to the monetary fine, this infraction results in the loss of 3 points on the driver's license.
Specific situations: if If the driver is involved in an accident while using a mobile phone, the penalties may be more severe.
Allowed equipment: The use of hands-free devices, such as Bluetooth systems, is permitted, as long as the driver does not have to handle the mobile phone while driving.

Authorities have been stepping up enforcement, especially in urban areas and on busy roads, to reduce accidents caused by distracted driving.
