Judge: Among the risks of using artificial intelligence in the judiciary is the protection of privacy

Prague – The risks of using artificial intelligence (AI) in justice include, for example, protection of privacy and information security, threats to the transparency of decisions or the risk of discrimination against those who would not have access to the technology in the proceedings. The benefit can be faster decision-making, automation of routine tasks and a reduction in the administrative burden for the courts. Roman Horáček, vice president of the High Court in Prague, said this at today’s conference on artificial intelligence in justice.

“If we believe that the decision was not made by a judge, but by artificial intelligence, we will naturally doubt it,” Horáček said.

According to him, the use of AI in justice will raise not only legal, but also ethical questions that will have to be answered. “Is the court there to provide the participant with access to AI in cases where the other party will have it?” the vice president stated one of them. Horáček considers the issues of ethics and transparency to be crucial.

Vice-President of the European Commission for Values ​​and Transparency Věra Jourová pointed out that artificial intelligence must not replace the decision-making activity of judges. Deputy Minister of Justice Karel Dvořák said that artificial intelligence can be useful in justice, but it must be reliable.
