(Seoul = Newsis) Reporter Lee So-heon = While former Minister of National Defense Kim Yong-hyun, who is accused of leading the ’12/3 martial law’ incident, was arrested and indicted, former Minister Kim’s side protested against the indictment and accused Seoul High Prosecutors’ Office Chief Park Se-hyun and others of defamation. He announced that he would sue.
According to the legal community on the 27th, the Prosecutor’s Office’s Emergency Martial Law Special Investigation Headquarters (Director Park Se-hyeon, Chief of the Seoul High Prosecutors’ Office) detained former Minister Kim, who is accused of engaging in important civil war duties and abusing power and interfering with the exercise of rights, to trial.
Former Minister Kim is the person who plotted martial law in advance and directly suggested it to President Yoon, and is the first person to be indicted on major rebellion charges.
The special report believes that former Minister Kim directed the operation by deploying martial law forces to the National Assembly and the National Election Commission and also intervened in the operation of the politician arrest team.
It is also believed that he ordered the arrest of politicians and National Election Commission employees and was involved in organizing and operating the arrest team of the Armed Forces Counterintelligence Command.
The special version said, “The results of the actions of the defendants constitute a violation of the national constitution,” and “It corresponds to a ‘riot,’ which is a component of the crime of rebellion under the criminal law.”
Former Minister Kim’s side later issued a statement and claimed, “The prosecution revealed that it had filed an indictment against former Minister Kim, and this is an indictment that almost directly quotes the announcement of the Democratic Party’s Insurrection Investigation Team.”
He added, “It even includes content that was not included in the newspaper, and the report is a fiction made up of indictment facts as if it were a compilation of the Democratic Party’s guidelines.”
He also said, “According to the Criminal Procedure Act, the leaking of the indictment itself is a crime of defamation, and in addition, the unilateral publication of fabricated statements and illegal evidence violates the principle of Japanese indictment and is a crime intended to intimidate public opinion, even to the court.” .
He said, “We will strongly condemn and immediately file a complaint against the prosecution’s actions to trigger prejudgment prior to the trial and to fill in the lack of evidence with public opinion incitement,” and added, “The illegality of the dismissal of the indictment will be clearly revealed at the trial.”
