LinkedIn fined $335 million for privacy violations

LinkedIn, actually parent company Microsoft, has one fine fined $335 million by the Irish Data Protection Commission (DPC) for privacy breaches.

The GDPR requires that the use of personal data has a valid legal basis. That didn’t appear to be the case for the company’s tracking ads.

LinkedIn had attempted (in various ways) to claim legitimate interests in profiling for behavioral advertising. LinkedIn also did not comply with the European principles of transparency and honesty.

In a statement, DPC Deputy Commissioner Graham Doyle said: ‘The lawfulness of processing is a fundamental aspect of data protection law and the processing of personal data without an appropriate legal basis is a clear and serious breach thereof.’

The case was started years ago by the digital rights non-profit organization La Quadrature Du Net. The country’s data protection authority then passed the complaint on to the DPC.

LinkedIn say that, ‘while we believe we are compliant with the General Data Protection Regulation (GDPR);, it will amend its advertising policies.
