Marlaska pointed out this Monday that “he is already studying the way” in which the decoration can be withdrawn from Víctor Gonzalo de Aldama, which was granted to him in September 2022. This is the Order of Merit of the Civil Guard, with a white badge category. A recognition that was carried out at the proposal of the then General Director María Gámez. The final document is signed by the Minister of the Interior Fernando Grande-Marlaska.
The granting of this type of recognition is included in the internal ordinance of the Civil Guard. It specifies details as particular as the way in which the recognition can be displayed, both in the case of uniformed and civilians: “Possession of these crosses will give the right to display them on the uniform or in civilian attire,” it details. .
It even includes the way in which the medal must be placed. Holders of more than one of these decorations in their categories of crosses with a red and white distinctive may only wear one of the same class, and must place, for each of those subsequently awarded, a pin on the ribbon, made of metal equal to that of the the cross, with the dates of the successive concessions: “In such cases, the maximum number of pins on the ribbon will be five on each cross, and may carry the ribbons that are necessary to show off the entirety of the cross. decorations”.

The latest revelations provided by The World reveal how the ceremony took place in which the distinction was awarded to Víctor de Aldama, where his “tribute to Spain” and his “deep values“. The same regulations, however, include a caveat: the possibility that some of the recipients do not display conduct in accordance with the values that the Civil Guard represents. And can one of these decorations be revoked? Representative associations of the Armed Institute question it. It should be remembered that, in addition, Víctor de Aldama is a person who is under investigation. And that no judicial sentence has yet been imposed on him, despite being immersed in several cases in which he himself is the protagonist, such as the alleged hydrocarbon fraud worth 182 million euros.
Marlaska assures that he is already studying the formulas to annul Aldama’s medal. The procedure should probably be based on the article 105 of the Law on the Legal Regime of Public Administrations and the Common Administrative Procedure: “Public Administrations may revoke at any time their tax or unfavorable acts, provided that such revocation does not constitute a dispensation or exemption not permitted by law, or is contrary to the principle of equality, to the public interest or to the legal system”.
A procedure that has procedures and some deadlines that will hardly fit into Fernando Grande-Marlaska’s intention to revoke Aldama’s medal as soon as possible. For the moment, it may prohibit you from using it in public events, as established by the internal regulations of the Civil Guard.
