BANJALUKA, DOBOJ – In the desire to get rid of the competition in the procurement of fuel for the company “Elektro Doboj”, the company “Nestro Petrol” from Banja Luka played tricks and miscalculated, and started an unusual process of demolishing the tender in which it was selected as the most favorable bidder, the portal reveals. Namely, in mid-July, “Elektro Doboj” announced a tender for the supply of fuel for the needs of field units in Modriča, Samac and Brod for a period of three years, divided into three lots, with a total value of 360,000 KM.
The problems for “Nestro” start when competition appears on the e-auction, that is, the company “Bato petrol” from Doboj. In order not to leave the work to them, they offered a price below the market price for the first two lots, which means that they would not earn anything from this work.
More precisely, for Modriča, they offered a price that is over 20 percent lower than the market price, that is, by about 0.48 KM, while for the fuel lot in Šamac, they offered a price that is 25 percent lower than what is currently traded with fuel.
That price was ideal for “Elektro Doboj”, in which they conducted the auction precisely in order to get the best possible result. In accordance with that, they choose “Nestro Petrol” as the most favorable bidder at the beginning of September.
However, they did not get the fuel because “Nestro” started a legal battle in which he tried to challenge his own choice!
Namely, they complained to the Office for Review of Complaints (KRŽ) of BiH, where they unsuccessfully tried to challenge the participation of the company “Bato Petrol” in the auction, claiming that there was an omission by the contracting authority.
KRŽ did not even consider the request because it rejected it due to the lack of active identification, considering that he did not prove that he suffered any damage. It can be seen from their solution that they themselves are confused by the request of “Nestro Petrol”.
„The question arises as to what kind of damage was caused by the actions of the contracting authority when their offer was chosen as the most favorable“, it is stated in the decision of the KRŽ.
As they did not succeed in their intention, “Nestro Petrol” gave up the job. Drago Tatić, one of the first people in the “Bato petrol” company, told us that he offered them, as the second-ranked bidder, “Elektro Doboj” to take over the job, to which they agreed.
He assesses the behavior of “Nestro Petrol” as unprofessional and adds that correctness is a foreign and unknown concept for them.
„As a fair and reliable supplier to contracting authorities, we will sign the contract. So far, we have not refused any, even though we used to suffer significant losses, we have always delivered up to the last liter“, said Tatić.
We would like to remind you that “Nestro Petrol” is a company owned by Russian capital, previously known for the fact that it was often favored by public institutions and companies in the Republika Srpska mainly through conditions that only they can fulfill.
