New budget law on first homes

There are many new features of the Budget Law regarding real estate and for first homes: more time to sell a house already owned and more help in the case of a mortgage.

The news on the first house of the Budget Law

The Budget law for the 2025 introduced a series of corrective measures aimed at allowing a more easy transfer e purchase of new homes also through a series of economic and financial incentives for families and households.

There are many new features envisaged by the latest maneuver approved regarding the home and, in general, the real estate sector.

In particular, the current executive has focused heavily on real estate marketas a possible driving force for the restart of our country’s economy, focusing on a theme always dear to Italians: the home ownership.

First home relief: more time to sell

The budget law grants 2 years time for the owner who purchases a new property to use main residenceenjoying the first home discounts despite already owning a property which was also acquired in a subsidized form.

Until today, in fact, the deadline within which to sell the pre-owned property, purchased with the first home incentives, to purchase another one in a subsidized form was equal to a year.

With the legislative change we will have more time.

The longer term of two years applies to those who sign a deed from 1 January 2025 but also to those who stipulated it in theanno 2024 and he hasn’t sold his house yet.

The reform, however, does not apply to those who signed a deed before 2025 and the one-year deadline established by the previous legislation has already passed.

The relief provided for the purchase of the first home also includes an important tax advantage of the so-called deed taxes and also of VAT, in the case of purchases of the real estate unit to be used as a main residence from a legal person such as the construction company.

In particular, the tax benefit consists of exemption from registration tax, mortgage e cadastral or alternatively, the accrual of a tax credit, for VAT purposes.

On this point, it is important to point out that these tax breaks also apply if you purchase an appurtenance for your first home.

First home mortgage and guarantee fund

Another important innovation, introduced with the budget law for the year that has just begun, concerns the extension for the three-year period 2025-2027 of the measure that facilitates access to first home mortgage.

The change was introduced by the 2025 Budget Law (Law 30 December 2024, no. 207, published in the Official Gazette), in paragraphs 112 to 116.

As is known, this is a measure that allows you to obtain coverage for thepurchasing your first home until it covers the80% of the capital invested in the property.

Access to this measure, pursuant to paragraph 115 of art. 1 of the Maneuver, is reserved for:

  • all young couples;
  • ai single parent families with minor children living together;
  • ai accommodation managers owned by independent public housing institutions, however named;
  • ai young under 36 years of age (so-called priority categories), if they are in possession of an equivalent economic situation indicator (ISEE) not exceeding 40 thousand euros per year and request a mortgage exceeding 80% of the value of the property, agreed upon in the agreement, including additional charges.

In order to allow the implementation of this measure, the Government has decided to expand the capacity of the Guarantee fundreplenishing resources.

Paragraph 114 expressly establishes an increase in the Guarantee Fund for the first home, referred to in article 1, paragraph 48, letter c), of law no. 147 of 2013, in an amount equal to 130 million euros for the year 2025 and 270 million euros for each of the years 2026 and 2027.

Supplementary deed for the purchase of a first home with VAT


In case of purchasing your first home from a legal entity, it is necessary to submit a supplementary act.

In other words, in the case of purchasing a first home for those under 36, the tax credit for VAT purposes is not recognized automatically, as happens for the tax exemption act, but a specific act of impulse from the person who intends to avail it is required of the benefit, which consists of a formal declaration, which must be drawn up following the formalities required for the deed of transfer of ownership of the property, i.e. through a notary.

Houses purchased at auction excluded from tax breaks


The purchased homes by a decree of the judge following a auction sale are excluded from the benefits and concessions in question.

The clear reference to the stipulation of a deed and a preliminary sale do not, in fact, allow such purchases to be included within the scope of the benefits provided for by the Budget Law.
