Police officers are obliged to accept the request of drivers

The government has made a new change regarding the collection of biological samples. From now on, the police are obliged to accept the request of drivers to carry out blood tests, regardless of the value indicated by the breathalyzer.

The new rules adopted by the Government, regarding the sanctioning of drunk or drugged drivers, entered into force.

Now, drivers with a low blood alcohol level can request both a retest and a blood test.

Romania has one of the most restrictive laws regarding alcohol consumption among drivers.

Both the old law and the new rules provide for the suspension of the driver’s license if the tests indicate the presence of alcohol in the body.

But, additionally, the new rules adopted by the Government establish that when the breathalyzer shows an alcohol concentration in the exhaled air between 0.1 and 0.10, drivers can ask for a retest.

But, he must wait at least 15 minutes and at most 20 minutes before he blows into the breathalyzer again. The alcohol concentration resulting from this second test will be the official one.

Initially, the Government established that if the second test also indicates an alcohol level between 0.1 and 0.10, the driver will be fined. In addition, the license was suspended for 3 months and he could not request a laboratory analysis.

However, the Government came up with a rectification in this regard.

Now, if there will be an alcohol concentration of up to 0.40 in the exhaled air, the driver can request blood tests.

If you have a blood alcohol level of 0.01 to 0.40 and you request the collection of biological blood samples, the policeman is obliged to take you to have it collected“, explained policeman Tavi Pertea on his YouTube channel.

He also said that if the breath test resulted in a value of 0.2, most likely the blood test result will be zero. Because it takes at least 30 minutes to draw blood. Enough time for this small amount of alcohol to be metabolized in the body.

I think it was best (…) to say clearly, at an alcohol blood level below 0.10, inclusive, no penalty is applied. I have not seen anyone with a blood alcohol level of 0.02-0.03 who has impaired psychophysical abilities and is unable to drive“, the policeman also said.
