The Directorate of the Chief State Architect of the Ministry of Spatial Planning, Urbanism and State Property annulled the decision by the Chief City Architect Kristina Bulatović Pejić did not give consent to the company “Beppler & Jacobson Montenegro” for the installation of a hangar in the Kolašin park next to the hotel “Bjanka”.
The directorate, deciding on the appeal of the company that is the investor, concluded that the decision was not made in accordance with Article 22, paragraph 7 of the Law on Administrative Procedure. For this reason, in addition to annulling the decision, the case was sent back for retrial and decision.
The Ministry concluded that “the first-instance authority only stated that the conceptual solution in question of the temporary facility of the assembly hall or hangar does not correspond to the found natural context in terms of the ambient spatial value of that area, and that it would damage the ambient value of the given area and the city as a whole with its dimensions and design… ”
However, as they claim in that department, there was no explanation for such a statement.
“The finding that the planned object does not fit into the existing environment, that is, that it violates the existing natural context, needs to be supported by the factual situation in the sense of providing an explanation as to which specific elements of design and materialization (form, dimensions, materials, colors) are not in harmony with the neighboring facilities in the environment and do not comply with the conditions and guidelines of the Program for the installation of temporary facilities. In this regard, it is concluded that the first-instance authority did not fully establish the factual situation when deciding on this issue,” the statement of the Directorate of the Chief State Architect reads.
Bulatović Pejić previously explained that she made the decision based on an insight into the conceptual design of the assembly hall or hangar, and considering the “ambient and spatial value of the area, with the aim of preserving the identity and recognition of the natural and cultural area”.

According to the urban planning and technical conditions (UTU), issued to the investor by the Secretariat for Spatial Planning, Communal Affairs and Traffic, the possibility of setting up a warehouse with an area of 600 square meters and a height of up to 15 meters has been left. Investors also found support for the installation of hangars in the Program for Temporary Facilities, which was adopted in 2019, i.e. in the amendments to that document, which were adopted three years later.
The program specifies that on cadastral plot 278, within the scope of zone II, at location 36, which is on the edge of the park, a prefabricated-dismantling or immovable temporary building, the maximum area of which is 610 square meters, will be erected.
The only park in Kolašin, due to still unclear circumstances, became the property of the company after the privatization of the hotel. Decades before that, according to local chroniclers, the Municipality only gave the park for use by the former hotel “Bjelasica”, i.e. to the state enterprises within which it functioned.
This area, which was designated as a city park in the early 1960s, is the only green area in the city center, with several dozen coniferous trees. An adventure park from another private company was installed there, as well as a children’s playground and an outdoor gym, which were municipal investments a few years ago.
