Hundreds of drivers were left, this winter holiday period, without a driver’s license because of alcohol. The police carried out numerous verification actions to detect drivers who get behind the wheel while drunk. Here are the rules, in 2025, for regaining a suspended alcohol license and what documents are required.
When a driver is caught behind the wheel under the influence of alcohol, the license is suspended on the spot.
If the alcohol concentration is low, the Police will only apply a fine. But if it is over the limit established by law, then the act is considered a crime.
Which leads to the preparation of a criminal case, and the driver risks up to 5 years in prison.
What is the blood alcohol limit in Romania?
Emergency Ordinance 195/2002 establishes the limits of pure alcohol in exhaled air and its concentration in the blood. It also provides for the sanctions that the police can apply to the person who committed the offense.
Thus, for a concentration between 0.01 and 0.40 mg/l of alcohol in exhaled air, the driver will be fined for contravention. At the same time, the driver’s license will be suspended for 90 days. And the policeman can apply a contravention fine between 1,822.5 lei and 4,050 lei.
„Driving a car or tram on public roads by a person with an alcohol concentration of over 0.80 g/l of pure alcohol in the blood (over 0.40 mg/l of pure alcohol in the exhaled air) is punishable by imprisonment from 1 to 5 years”, establishes ART. 87 of the Emergency Ordinance 195/2002.
Therefore, an alcohol concentration of over 0.40 mg/l in exhaled air is a crime.
Which leads to the preparation of a criminal file and the suspension of the driver’s license for the entire period of the criminal investigation.
The same penalty applies to those who drive under the influence of drugs.
2025: Reacquisition of suspended alcohol license
Drivers who have been fined for driving under the influence of alcohol can only regain their license at the end of the suspension period. In their case, there is no possibility of obtaining a reduction of the suspension period.
Instead, drivers whose act was classified as a crime will have their license suspended for an indefinite period.
The law states that the license of those who have the right to drive suspended for alcohol or drugs cannot be regained until the completion of the criminal investigation or after the execution of the sentence.
