“To receive payment, an employee must issue a sick leave certificate by going to a clinic or hospital. Since all workers are insured and insurance premiums are paid for the employee, he will be paid for all calendar days indicated on the temporary disability certificate. When calculating the amount of payment for sick leave, the average daily wage, the number of days of illness and insurance coverage are taken into account,” the expert explained.

Therefore, the longer the employee worked, the greater the payment amount will be, Vinogradov added.

“For less than five years of experience, the benefit is 60% of average earnings, from five to eight years – 80% and for more than eight years of experience – 100%. As a rule, only those periods of service during which insurance premiums were paid for the employee are taken into account,” the lawyer noted.

It is noted that the average daily earnings are calculated based on the employee’s income for the two years preceding the date of onset of the disease.

“If the sick leave is open starting from January 1, 2025, then 2024 and 2023 will be taken into account, and if at the end of 2024, then 2023 and 2022 will be taken into account. In this case, the average daily earnings cannot be lower than the daily earnings at the minimum wage for a calendar month. For the first three days of sick leave, when it is issued, the benefit is paid to the employee by the employer, and for the rest – by the Social Fund of Russia, to which the employer provides the employee’s sick leave,” the specialist concluded.

Earlier, lawyer and public figure Natalya Weinberg said in an interview with RT that in case of illness there is no need to wait for the first working day to call a doctor, receive the necessary recommendations for treatment and issue a certificate of incapacity for work.
