The USA first passed Executive Order 13219 of June 26, 2001 on “Blocking the assets of persons who threaten international stabilization efforts in the Western Balkans”.
That decree was amended by Executive Decree 13304 of May 28, 2003, on “Ending the Emergency in Yugoslavia and Amendments to Executive Decree 13219”.
Executive Order 13304 was replaced in an expanded scope by Executive Order 14033 of June 8, 2021, which refers to “Blocking of assets and suspension of entry into the United States of certain persons who contribute to the destabilization of the situation in the Western Balkans”.
This regulation (14033) is amended by the additions determined by the Biden administration by replacing Article 1, instead of which the provisions mentioned in the text of the new document are inserted.
The statement indicates that individuals engage in serious corruption that undermines the rule of law and trust in democratic governance and that they avoid sanctions from the US government.
It is announced that additional steps will be taken in connection with the national emergency declared by Executive Order 13219 of June 26, 2001, on freezing the assets of persons who threaten international stabilization efforts in the Western Balkans, which is why, according to reports, President Joseph Biden has ordered changes to the Executive Order 14033.
“Executive Decree 14033 is hereby amended by deleting Article 1 and inserting the following in its place:
Article 1. (a) All property and interests in property located in the United States of America, which hereafter become vested in the United States, or which are or are hereafter to come into the possession or control of any blocked person in the United States of America, shall not be transferred. , paid, exported, withdrawn, or otherwise dealt with and to any person designated by the U.S. Secretary of the Treasury, in consultation with the U.S. Secretary of State.
(1) Refers to persons who are responsible or act as an accomplice, or have directly or indirectly participated or attempted to participate in actions or policies that threaten the peace, security, stability or territorial integrity of any area or state in the Western Balkans;
(2) The measures also apply to persons who are responsible or accomplices, including through participation in development, or directly or indirectly participate or attempt to participate in actions or policies that undermine democratic processes or institutions in the Western Balkans;
(3) It also refers to persons who are responsible or act as an accomplice, or have directly or indirectly participated or attempted to participate in a violation, or an action that hindered or threatened the implementation of any regional security, peace agreement, cooperation agreement or mutual recognition or framework or mechanism of responsibility, or represent a significant risk for the execution of such action, related to the Western Balkans, including the Prespa Agreement from 2018, the Ohrid Framework Agreement from 2001, Resolution 1244 of the UN Security Council, the Dayton Agreement or the Conclusions of the Peace Implementation Conference held in London in December 1995.
This includes the decisions or conclusions of the High Representative for Kosovo and Metohija, the Peacekeeping Council or its Steering Committee, the International Criminal Tribunal for the former Yugoslavia, or in relation to the former Yugoslavia, the decisions or conclusions of the International Residual Mechanism for Criminal Courts;
(4) A person who is responsible or is an accomplice, or has directly or indirectly participated or attempted to participate in a serious violation of human rights in the Western Balkans;
(5) A person who is responsible for or is complicit in, or has directly or indirectly participated or attempted to participate in corruption related to the Western Balkans, including corruption by, on behalf of, or otherwise associated with the government of the Western Balkans, or current or a former government official at any level of government in the Western Balkans, through misappropriation of public funds, expropriation of private property for personal, political purposes, or acceptance of bribes;
(6) A leader, official or member of an entity, including a governmental entity, who has participated or attempted to participate in any of the activities described in subparagraphs (1) through (5) of this regulation, or whose assets and interests in assets are blocked under to this regulation;
(7) A person who materially assisted, sponsored or provided financial, material or technological support for goods or services, or supported any person whose assets and interests in assets are blocked under this regulation;
(8) A person who belongs to or is controlled by, or has acted or represented to act for or on behalf of, directly or indirectly, any person whose assets and interests in assets are blocked under this regulation;
(9) Property belonging to or under the control, directly or indirectly, of any person whose property and interests in property are blocked under this regulation; or
(10) A person who is the spouse or adult child of any person whose property and interests in property are blocked under subsections (1)(a) of (1) to (5) of this regulation.
(b) The prohibitions in sub-paragraph (a) of this article apply except to the extent provided by law, or in regulations, ordinances, directives, or licenses that may be issued under this ordinance and regardless of any contract entered into or any license or permit. issued before the date of this regulation.
Article 2 of the General Provisions. (a) Nothing in this regulation shall be construed to limit or otherwise affect:
(1) Powers granted by law to an executive department or agency, or their managers; or
(2) To the functions of the director of the office for management and budget in connection with budgetary, administrative, or legislative proposals.
(b) This ordinance shall be implemented in accordance with applicable law and is subject to the availability of funds.
(c) This regulation is not intended to and does not create any right or benefit, substantive or procedural, enforceable at law or at right by any party against the United States, its departments, agencies, or entities, their officers, employees, or agents, or any other persons, according to the decree signed by outgoing US President Joseph Biden published on the White House website.
