The Consell de Guaranties Statutàries has declared constitutional the tax reform presented by Esquerra y Comuns that regulates gambling taxation for Hard Rock. The proposal of the two parliamentary groups calls for modifying the tax exemption for this recreational center in Vila-seca that CiU and the PSC endorsed in 2014 and that allowed the promoters to pay taxes of 10%, and not 55%.
“The proposed law to modify Law 6/2014, of June 10, to modify Law 2/1989, of February 16, on tourist recreational centers, to establish rules on taxation, commerce and gaming “It does not violate the principle of legal certainty included in article 9.3 of the Spanish Constitution and, therefore, it is constitutional,” concludes the 49-page opinion of the Consell de Garanties, who assumes his opinion unanimously.
Although this body is advisory and, therefore, its texts are not binding, Junts’ request prevented the Parliament from approving in its last plenary session in 2024 the modification promoted by ERC and Comuns and which has the approval of the PSC and the CUP. It is for this reason that, if a plenary session is not expressly called before, the initiative will not go ahead until the end of January (on the 28th, 29th and 30th) when the first session of the Catalan Chamber is held next year.
Reverting the tax benefits to the Hard Rock is a commitment made by Salvador Illa with ERC and the commons during the negotiation for his investiture. It is a measure that Republicans and commoners consider “definitively burying” the recreational project. But parties such as the PP or Junts have warned of possible economic consequences, as the contractual conditions are modified, as they say. However, both groups have also presented amendments to the entire ERC and Commons initiative, which are not expected to succeed.
The socialists assure that they will maintain their commitment to republicans and commoners, despite the fact that in the last plenary session they abstained in a motion that was carried forward by the popular ones that urged the Government to present the urban master plan (PDU) of the Hard Rock, today currently pending environmental reports.
