The equipment will be returned to the company from the “black list”, and then resold to the Ministry

In the annex, which was signed by Minister Edin Forto in September of this year with the aforementioned Zagreb company and company Nimbus Innovations d.o.o from Banja Luka, which took over all the rights, property and obligations of the sanctioned party Siriusa 2010it is stated that by the date of signing the annex, the entire equipment from two, out of a total of 10 chapters of the contract, was delivered, namely chapter 3. – Locations for analog broadcasting and chapter 4. Information and technical centers, and the total value of the delivered equipment is hidden in a copy of the annex that was submitted to TI BiH.

As this equipment has already been invoiced, the annex stipulates that the Ministry will return the equipment to the company.Nimbus Innovations” which will cancel the issued invoices. Then the aforementioned equipment will be taken over by a company from Zagreb, which will have it in hand for three days re-deliver to the Ministry.

Under the assumption that the Zagreb and Banja Luka companies will regulate mutual relations, in this way, according to TI BiH, the Ministry enabled the circumvention of US sanctions and endangered the public interest, risking a possible reaction from OFAC.

We remind you that Sirius 2010 doo BanjaLuka was the holder of a consortium with the Zagreb company “Odašiljači i veze” which, for the procurement of equipment for digital transmission and broadcasting for the Project of Digitization of Public RTV Services, gave an offer of about 25.5 million KM.

The annex to the contract stated that the company “Odašiljači i veze” doo submitted statements and certificates proving the technical and professional ability required by the tender documentation, i.e. proving that it has the ability to independently continue the implementation of the contract and fulfill all unfulfilled obligations.

Although another cheaper offer was submitted to the tender, the Ministry ultimately decided to choose a more expensive bidder, and the appeals review office rejected the appeal filed by a consortium of four companies “MIBO komunikacije” doo Sarajevo, “Roaming Networks” doo Banja Luka, “UNIS telekomunikacije” dd Mostar and “Flame Data Technologies” SRL Romania.

In the end, the job was awarded to a consortium led by Sirius 2010 doo, which later ended up on the OFAC blacklist, with allegations that it was inside the network of Milorad Dodik’s family, who used their political influence to steer millions of contracts to the network of companies they controlled.
