Elon Musk has been complaining about it for years the slowness of the Federal Aviation Administration responsible for environmental analysis and issuing licenses for rocket launches. It must be admitted, however, that the dispute has recently become much more heated. It started with Starship being ready for the fifth test at the beginning of August. Meanwhile, the FAA announced that the license won’t be issued until at least November. Of course, this didn’t sit well with SpaceX. The aerospace industry began publicly complaining about the FAA’s actions. In turn, as a form of retaliation, the agency decided to impose a financial penalty on SpaceX for alleged violations during flights in 2023.
Now it is safe to say that the balance of power is changing. Elon Musk will head a new department in Donald Trump’s government. Meanwhile, the FAA announced changes that will benefit private space industry companies such as SpaceX.
FAA announces changes to flight licensing
The US Federal Aviation Administration made a key announcement changes in the regulations regarding launch licensing and re-entry in space. On November 14, the establishment of a special committee was announced, whose task will be to review and update the regulations known as “Part 450”. These changes are intended to simplify the licensing process, increase its flexibility, and accelerate actions in the face of the dynamically developing space sector.
The FAA-established committee will include representatives from the space industry and academia. Their task will be to review the provisions of “Part 450” and propose changes that will make the licensing process more transparenteffective and adapted to the needs of the dynamically changing industry. A report with recommendations is to be presented by the end of summer 2025.
The committee’s main areas of interest include:
- Flight safety analyses,
- security systems,
- Compliance measures with new regulations.
The FAA emphasizes that the purpose of the changes is not only to support the success of the American space industry, but also to maintain its global leadership position and maintaining high safety standards. Fast and efficient licensing is a central element of this process, and its implementation requires close cooperation between the administration and the private sector.
The agency notes that private companies themselves can also contribute to faster licensing. The recommendations for enterprises include:
- Using FAA educational resources to better understand the requirements,
- Submitting complete applications with appropriate justification,
- Avoiding changes to applications during their evaluation,
- Quickly respond to FAA inquiries
- Optimized mission planning to reduce the number of required license modifications.
The Federal Aviation Administration will have more and more work
In recent years we have seen a rapid increase increase in the number of commercial space launches. In fiscal year 2024, the FAA issued a record 148 launch and return licenses, a 30% increase over the previous year. FAA experts predict that this number may even double by fiscal year 2028. Such rapid development of the sector makes the existing regulations insufficient, and adapting them to current needs becomes a key challenge.
The biggest driving force behind this change is the activities of SpaceX, which has already carried out over 100 orbital missions this year. Most of them were related to the development of the Starlink satellite constellation, providing broadband Internet around the world. Elon Musk, the founder of SpaceX, has long criticized the applicable regulations, claiming that they hamper the development of the American space industry. Now, however, thanks to new actions by the FAA, there is a chance to significantly improve the situation.
