The Prosecutor’s Office supports a new pardon for Junqueras as the Supreme Court does not amnesty the embezzlement

The Prosecutor’s Office supports a new pardon for Oriol Junqueras. In a report sent to the Second Chamber by the lieutenant prosecutor of the Supreme Court, Ángels Sánchez Conde, It maintains that the grace measure is appropriate after the Supreme Court has refused to grant amnesty for the crime of aggravated embezzlement for which the former Catalan vice president was convicted after the events of the ‘procés’.

And it is that, according to Sánchez Conde, The granting of the pardon “seems pertinent as it is excessive to continue serving the disqualification sentence, taking into account the circumstances in which the crime was committed and that other participants in events that are part of the so-called Catalan independence process will see it extinguished their criminal responsibility without being prosecuted”.

The lieutenant prosecutor recalls that the amnesty law was promoted to “overcome the aforementioned tensions” and eliminate part of the circumstances that “cause the disaffection that keeps a part of the population away from state institutions.” And in this regard, he considers that this disaffection is nourished by the condemnation of Junqueras, perhaps the most important “milestone” to “provoke” said feeling. This is due to the fact that the republican, referred to as the Catalan “leader of the process”, “has been imprisoned, has been tried and convicted and has served his sentence extensively”, which has resulted in a “deep upheaval in Catalan society.”

Being so, Sánchez Conde arguesand in the “hypothesis that in the opinion of that Chamber it becomes firm and it is understood that the facts that determined the conviction for misappropriation of the sentence are not susceptible to being amnestied”, it is appropriate “to grant the requested pardon.”
