Many drivers who are caught driving with an expired ITP or serious technical faults in their car receive a fine and have their license plate seized. To get it back, you have to go to the Romanian Auto Registry. However, the registration certificate will not be returned by RAR.
Many drivers whose registration certificate was withheld because they drove a car with an expired ITP or serious technical deficiencies presented themselves at the Romanian Auto Registry to recover their car registration.
To their surprise, however, when they arrived at RAR they found out that this document cannot be returned to them. At least not by the Vehicle Registry.
The Romanian Car Registry does not return the seized car ticket
„I came to RAR to retrieve my coupon“, is the expression that employees of the Romanian Auto Registry hear most often.
Drivers whose registration certificate (CI) has been suspended, present themselves at the RAR offices to reacquire the ticket.
„If the CI was detained only for the lack of ITP, the technical check is carried out at the RAR representative office as provided in RNTR 1. If the CI was detained for technical defects, only their remediation is checked at the RAR representative office, with except for the situation in which other non-conformities can be ascertained by direct observation”, it is stated in a post published on the Facebook page of the Romanian Car Registry.
If it is found that the deficiencies no longer exist, the RAR representative will state this on the original of the replacement proof of registration certificate. Also, if the vehicle is declared admitted to the ITP, a proof of this verification will be issued.
And with one of these proofs, or with both if necessary, the owner must present himself, then to the Police.
„Our colleagues do not have the right to stop vehicles in traffic nor to withhold a registration certificate. During a control carried out by a mixed RAR-Traffic Police crew, these decisions can only be made by the MAI representative. The specialists of the Romanian Car Registry only check the vehicle with the help of the equipment available in the CTT auto laboratory and draw up a report with the findings, which they hand to the traffic policeman” RAR representatives also state.
Documents required for checking the car at RAR
If the car ticket has been withheld for expired ITP or serious technical deficiencies, it can only be recovered after the vehicle is subject to a RAR check.
Which means that the owner must present himself with the vehicle at the Vehicle Registry and with a series of documents.
The necessary documents are:
- Vehicle Identity Card;
- proof of retention of the original registration certificate (or a notarized declaration in case it was lost);
- the report with the findings made during the technical traffic control (only if the CI was detained following the checks carried out by a joint RAR-Traffic Police crew);
- the RAR activity application (it will be filled out holographically by the applicant on his own responsibility and will be signed in the presence of the RAR employee who performs the service);
- the identity document of the person requesting the activity.
Then, if he obtains the right to drive, the driver must present the proof issued by the RAR at the police station that ordered the retention of the driver’s license.
How to recover the car ticket
„The registration or registration certificate and plates with the registration or registration number, (…) shall be returned to the owner or user of the vehicle by the traffic police, upon presentation by him of the proof of the termination of the reason for which the document was detained, under the conditions provided in regulations”, it is stipulated in Art. 112, point 4 of Law 195/2002.
Therefore, the drivers whose ticket was withheld must prove that they have remedied the technical deficiency. Or they obtained the documents to be able to circulate legally.
Once the problem has been solved or the documents have been drawn up, the following documents must be presented to the Traffic Police headquarters:
- identity card;
- replacement proof of the registration certificate;
- the documents by which you demonstrate the remedy of the problem (RAR notice);
- the receipt proving that you have paid the penalty received.
After these documents are presented, the registration certificate and plates with registration numbers (if applicable) will be returned.
