Warrant dismissed for obstetrician accused of conspiring to kill disabled infant

The arrest warrant for an obstetrician-gynecologist was dismissed in connection with the death of a disabled infant who was found dead a week after birth.

On the 26th, Chief Judge Kim Seung-ju of the Cheongju District Court in charge of warrants dismissed the arrest warrant for Mr. A, a Cheongju obstetrician and gynecologist suspected of murder, after interrogating the suspect before arrest (warrant substantive review).

Chief Judge Kim explained, “It is difficult to acknowledge that there is a risk of the suspect running away, and since the evidence has already been secured, we cannot acknowledge the concern that it will be destroyed.”

He also added, “The police also took into account the fact that the prosecutor dismissed the application for the biological father, who had applied for an arrest warrant, on the grounds that there was no risk of him running away or destroying evidence.”

Mr. A is accused of conspiring with Mr. B and his wife to kill a one-week-old disabled infant on the 10th of last month.

Mr. B and his wife gave birth to a child on the 3rd of last month.

At the time, it was known that the child was born with a congenital defect in one arm.

The child was found lying face down on the bed on the 10th of last month and had stopped breathing.

As a result of the autopsy, the National Institute of Forensic Science determined that the cause of the child’s death was asphyxiation.

The police charged the couple with manslaughter and began an investigation.

The decisive clue that changed the direction of the investigation was the cell phone.

The police confirmed new circumstances as a result of digital forensics on the couple’s cell phone, which was seized and searched.

Mr. A’s voice was also included in this cell phone recording.

It is reported that it contains closed-circuit (CCTV) TV and death certificates.

It is known that during this process, the couple protested to Mr. A, saying, “We were able to find out about the disability in advance through an ultrasound examination.”

During the police investigation, the mother admitted the charges, but Mr. A denied the charges.

The police had previously obtained a warrant from the court the previous day and arrested the mother.

The police applied for an arrest warrant for the father on the same charge, but the prosecution rejected the warrant due to the fact that he had children to support.
