When is the driver’s license withheld? Violations leading to the suspension of the right to drive

The driver’s license can be withheld in several situations, including for minor but repeated violations. Here are the most common mistakes that can lead to suspension of the right to drive.

Drivers can have their right to drive a motor vehicle suspended when they break certain traffic rules. Some situations are serious, such as running a red light, others may seem less dangerous, such as using a mobile phone.

Even minor but repeated offenses such as illegal parking can lead to the suspension of your driving license.

When the driver’s license is withheld for 30 days

The driving license can be withheld for 30 days in the following situations:

  • using or holding a phone, tablet, laptop or any mobile device;
  • overtaking the column of cars stopped at a traffic light or railway crossing;
  • not giving priority to vehicles or pedestrians;
  • crossing the red traffic light;
  • irregular overtaking;
  • disobeying traffic police signals;
  • accumulation of 15 penalty points;
  • failure to report to the police within 24 hours of an accident resulting only in material damage.

When the driver’s license is withheld for 60 days

The suspension of the license for 60 days is ordered when:

  • a traffic accident occurred as a result of not giving priority, irregular overtaking or if the driver ran a red light;
  • the temporary traffic ban on a public road was not respected;
  • an irregular overtaking was carried out;
  • traffic rules related to official columns were not followed or the driver joined such a column;
  • he drove in the opposite direction, in violation of overtaking rules
  • the driver accumulates 15 penalty points again within 12 months from the expiry date of the last license suspension.

When the driver’s license is withheld between 90 and 120 days

Suspension of the right to drive for a period of 90 days is taken if the driver:

  • drove under the influence of alcohol, if the act does not constitute a crime;
  • drove a vehicle with problems with the braking system or the steering mechanism.

The retention of the carnet for 120 days is ordered if the driver:

  • turned onto the highway;
  • drove the wrong way on the highway;
  • did not follow the rules at the railway crossing;
  • exceeded the legal speed limit by more than 70 km/h.

From when the license suspension is calculated

If the driver’s driver’s license is suspended and he receives a replacement proof with the right to drive for 15 days, the suspension is calculated:

  • from the moment of expiry of the validity period of the substitute proof;
  • from the moment of submission of the substitute proof, by the driver, to any traffic police unit on one of the days of its validity period.

In the situation where the driver’s license is suspended with proof of no driving right, the suspension period is calculated from the moment when:

  • the statement of findings is drawn up;
  • is notified of the suspension of the right to drive (if the report was drawn up in the absence of the driver, for example, for exceeding the speed limit).
