BANJALUKA – Citizens of the RS will not have to attach certificates of residence to obtain various legal services from a notary, which was the obligation and practice until now, but notaries will electronically access the records of residence and residence of citizens and check the data from the records in a simple way.

This was made possible by the Agreement on electronic data exchange, which provides for the connection of notary offices in the Republic with the public records of the Ministry of Internal Affairs, which was signed by the Ministers of Internal Affairs and Justice of the Republic of Srpska Siniša Karan and Miloš Bukejlović with the President of the Chamber of Notaries of the Republic of Srpska Borislav Radić.

Karan thanked the Chamber of Notaries, on whose initiative this activity was launched, emphasizing that the Ministry of Interior is open to cooperation when it comes to the electronic exchange of data from public records, and that the Ministry of Interior is at the disposal of other interested institutions and administrative bodies, banks and business entities.

The Ministry of Internal Affairs enables free verification of personal data in accordance with the law.

Bukejlović said that the electronic exchange of data will affect the more efficient functioning of the notary system, as well as that the Ministry of Justice will coordinate and supervise the Chamber of Notaries and notaries.

“Citizens in Republika Srpska will perform legal affairs related to notaries in one place”, said Bukejlović, they write Independent newspaper.

When performing notary services, notaries will use the established service for the purposes of obtaining data on the address of residence/residence for natural persons, i.e. citizens who use their services, all in accordance with the provisions of the Law on Notary Services in the Republic of Srpska and the Law on Prevention of Money Laundering and Financing terrorist activities.

Radić pointed out that the importance of signing this agreement is reflected in the fact that enabling the electronic exchange of data facilitates and speeds up the work process of notaries, because citizens in the territory of the Republic of Srpska, when using the services of notaries, will not be obliged to go to police departments and obtain certificates of place of residence, that is, residence, which was currently the case, but the notary will determine this information by direct inspection of the database.

He noted that for the notary service, the connection of these two institutions is very important, because in this way trust has once again been shown to notaries, i.e. the notary service, which works together with all participants in this process to achieve the goal, which is that the procedure before the notary for citizens to be fast and efficient, and that they can do legal work in one place without visiting several institutions to obtain the necessary documentation.

He stated that the Chamber of Notaries has already signed an agreement with the Tax Administration of Republika Srpska, which enables notaries to perform an electronic review of the state of tax obligations of persons who sell real estate without the need for parties, i.e. citizens, to go to the Tax Administration for certification, and this system will in a few days, if everything goes according to plan, to be put into operation, that is, from August 1.

The President of the Chamber of Notaries of the Republika Srpska noted that the Chamber of Notaries is constantly working to improve the notary service and does everything to enable citizens to perform legal affairs with a notary as efficiently as possible, without the need to go to several places to obtain the necessary documentation, and in this direction recognized the importance of connecting notary with public records and other registers.

Further goals of the Chamber of Notaries are, as announced, the connection with the registers, as well as with the registers of business entities of the district commercial courts, in which way relief would be provided to business entities so that they do not have to obtain current statements from a notary for the purposes of performing legal affairs, but would through the electronic exchange of data between notaries and courts, it was possible to gain insight into the state of the registered business entity.

In this direction, the Chamber of Notaries sent a proposal to the Ministry of Justice to amend the Law on the Registration of Business Entities in the Republic of Srpska, and hopes that this activity will be implemented quickly.

Radić expressed the expectation that in the near future the possible connection with the records of the Republic Administration for Geodetic and Property Legal Affairs of the Republika Srpska will be completed, which will completely complete the process of electronicization of the notary service, from which the citizens will benefit the most because they will be freed. obligations to obtain documentation and other public documents.
